Microsoft files civil case against KK Software

The software giant has sued KK Software Solutions for the recovery of damages of Rs 5.71 crore in connection with his involvement in the selling of Microsoft counterfeited software and other illegal activities

Microsoft India has filed a fresh Civil Case against Kamlesh Kumar Jha (KK Jha), the owner of Delhi based firm KK Software Solutions, at the Delhi High Court on December 22, 2012. The software giant has sued KK Software for the recovery of damages of Rs 5.71 crore in connection with his involvement in the selling of Microsoft counterfeited software and other illegal activities.

While confirming this development to The DQ Week, Microsoft spokesperson said, "We are demanding damages worth Rs 5.71 crore in connection with the ongoing 2009 raid case. The CBI conducted raid at KK Software Solutions and recovered counterfeited software worth Rs 5.71 crore from his office in the same year."

The civil case has been accepted by the court and the first hearing in this case was pronounced on January 8, 2013. The hearing has gone in favor of Microsoft, where the court has ordered KK Software to disclose details of his assets in affidavit, and also directed him to restrain from aligning any alienating of Microsoft assets.

However, when The DQ Week contacted Jha, he replied, "Till date, there was no case pending in any court against us. Regarding this civil case, I don't have any clue, may be Microsoft might have filed it in last 5-7 days. We don't sell Microsoft OEM products from last 4 years. But the company has been implicating my firm in false charges and disturbing my business."

He also claimed, "As I have already won one case filed against me in the year 2005, and in case of 2009 all the seized material was found genuine and later was released by Chief Metropolitan Magistrate (CMM) court in the year 2011, keeping one sample of each product, then these products were sold by lot many resellers and none of them found any problem in registering them with Microsoft. Therefore,we don't understand on what ground Microsoft is demanding Rs 5.71 crore damages."

The next hearing in the ongoing case of 2009 is due to take place on January 28.
