Submitting fake cheques is no more a child's play; taking cognizance of the
compliant filed by MC Modi and Co the Jabalpur Court has imposed a penalty of Rs
4 lakh each and eight months imprisonment to one Sunita Joshi and Shailender
Gupta on cheque bouncing charges. The duo were running BTech Computer in
Jabalpur IT market since several years and it was allegedly that they were
involved in the cases of fake cheques submission to Jabalpur IT dealers.

The appellant (MC Modi) had filed a criminal suite against the phony duo
under section 138 of Negotiable Instruments Act (the act that penalizes
signatory of the cheque that bounces due to varied reasons) some three years
ago.

Around four cheques of Rs 1.50 lakh each totaling to Rs 6 lakhs produced by
Joshi and Gupta against the payment of computer spare parts to Modi had bounced.
Despite Modi sending numerous requests, the duo were not returning the pending
dues, which compelled the plaintiff to move court and register a complaint
against them.

The courts judgment passed by Magistrate AK Singh of Jabalpur Court would
perhaps, act as an eye opener for fraudsters that have mushroomed in IT trade.
Triumphed over courts decree JP Modi, Director, Modi Peripherals said, “The
courts verdict of imposing penalty along with jail imprisonment to the wrong
doers has come at a very accurate time. The judgment will conceivably demoralize
the lobby of people who are intentionally eroding business ethics by indulging
in fraudulent activities.”

“The increasing menace of cheque bouncing is continuously putting IT
dealers in a dilemma but this decision by Jabalpur Court will surely work as a
milestone for the community,” Modi added. He also informed how patiently he
followed the case and made sure that he did not miss even a single hearing.

The judgment in Modi's case will definitely send stern warning to the
swindlers but it will also encourage people who have been suffering due to such
frauds to come forward and report such cases.
