In a belated move MS terminates KK Software as Associate Distributor

counterfeited products, software giant Microsoft has done it all
with
the owner of KK Software. Now in a rather belated decision, after
full four months of the CBI raid, Microsoft has terminated the
associated distributorship of Jha-owned KK Software Solutions. Jha
and MS have been associated with each other for over a decade.

In a release Microsoft said that the
termination can be attributed to Microsoft's criminal complaint
filed before the CBI , alleging high-end counterfeiting of software,
illegal download and duplication of product keys by KK Software
Solutions Pvt Ltd and its associate companies. Acting on a detailed
criminal complaint filed by Microsoft, the Central Bureau of
Investigation (CBI), New Delhi conducted raids on KK Software
Solutions Pvt Ltd and its affiliate companies across 14 locations in
Delhi, Ghaziabad, Jaipur and Hyderabad in December of 2009. As per
Microsoft's complaint, among other things, the company has alleged
and claimed that KK Software and its owners were defrauding and
cheating both the unsuspecting customers and resellers by indulging
in distribution of illegal counterfeit software,besides allegedly
violating Microsoft's Intellectual Property Rights. In the release
Microsoft stated that as a company it has always preached zero
tolerance on matters like counterfeiting and piracy .

When The DQ Week contacted Jha
for his reaction to the latest move by Microsoft, Jha who has come
out after spending 60 days in judicial custody said that even he was
not keen to continue the relationship either. In fact he said that he
was the one who initiated the termination, “It is good that they
have removed me as the associate distributor. In fact, I was the one
who initiated this process by returning Microsoft products that were
kept with me for the last two months. I worked with Microsoft for
over 10 years and look how they paid back my loyalty by putting me
behind bars. Microsoft will be very good to you as long as you don't
raise any voice against them. But the moment you start fighting for
the right thing, they reject you with utmost ease,” Jha retorted.

When asked if he had continued doing
business with Microsoft despite the raid, Jha claimed that in the
last four months his company had continued doing business selling MS
products, however when we contacted representatives of distributors
like Ingram Micro and Redington to find out the details of billings
to KK Software, they chose not to comment on the matter.

KK Software was raided by CBI on
Microsoft's complaint in December 2009 and as a result KK Jha had
been arrested by CBI. After spending 60 days in judicial custody Jha
had got bail on Feb 20, 2010 as CBI was unable to file a chargesheet
against him. However, CBI still continues to investigate the case.
