Progressive Channel Association of IT (PCAIT) is gearing up for the next
hearing of the state versus Sanjay Gupta case, which was filed by PCAIT members
in Feb 2006. Gupta of Gravis Computers had allegedly duped the channel community
of Rs 2 crore, of which around Rs 40 lakh was the amount owed to PCAIT members.

Giving an update on the case, V Krishnan, Executive Secretary, PCAIT stated,
“The appeal filed by Gupta is coming up on Oct 14. The case is in the lower
court of AD Magistrate Naveen Kumar and a hearing has been fixed for June 25,
2009. This is just for appearance of Gupta and for the Economic Offenses Wing (EOW)
officer to produce certain original documents. Only after the appeal in the
sessions court is rejected will the trial at the lower court resume.”

Krishnan and Ashok Taneja, Executive Council Member, PCAIT have been
appointed by the association as representatives at the court and to follow up
on its course.

Saket Kapur, General Secretary, PCAIT said, the case would stand as a
reminder to all the people thinking of committing such crimes of the
consequences of doing so.

Gupta had got out on bail after he gave a fixed deposit of around Rs 17 lakh
to the court. “The court has managed to get about 50 percent of the money owed
to PCAIT members back from Gupta. The money has not yet been returned, but PCAIT
members are ready to fight out the case till the end,” said Kapur. Besides, they
will also get interest on their amounts, depending on however long the case
takes to be solved.

Krishnan shared that the association would move the court to get the money
released and distributed among the members who had lost their money. “Though the
trial will continue and may take a few years, we are hopeful that within one
year the money that has been deposited with the magistrate should be released,”
added Krishnan.
