Delhi High Court grants interim injunction to Analog Devices

The Delhi High Court has granted an interim injunction after agreeing that an
India-based distributor of a Chinese semiconductor manufacturer must immediately
stop purchasing and distributing the Chinese manufacturer’s energy metering
semiconductor chips. These chips are counterfeits, which infringe on copyrights
and a valid patent, held by Analog Devices Inc.

According to the press release, responding to unlawful counterfeiting of its
high-performance semiconductor chips, ADI, has had its intellectual property and
passing off suit validated. The court found merit in ADI’s arguments citing
flagrant attempts both to harm ADI and Indian commerce. The suit charges
copyright infringement and passing off against Shanghai Belling Company
(Belling), a Chinese semiconductor manufacturer, exporting goods to India and
against Belling’s India-based distributor. The suit states that Belling has
copied ADI’s energy metering chips and is wrongfully trying to pass-off the
counterfeit chips as substitutes for ADI’s chips.

Commenting on this issue in India, Ashok Kamath, MD, Analog Devices India
said, "For over twenty years, Analog Devices has worked closely with the
Indian IT community and built a reputation for high-quality products in India.
Counterfeiting our technology and misusing the Analog Devices’ name is not
acceptable to us."
